Rules, HOAs and permits: where turf is allowed, and who decides

Colorado law, town codes and HOA rules each have a say. What they allow, and who to ask about your address.

Rules and HOAs · the guides

Four questions, each answered up front.

Each short answer is right here. Open a guide for the full explanation and its sources.

  1. Is artificial turf allowed in Northern Colorado?

Behind an existing house, usually yes. No town code clearly bans backyard turf; Firestone requires a permit and caps it, and Timnath’s and Frederick’s new codes leave backyards unsettled, so ask them. Colorado law bars HOAs from banning it behind a detached home. Greeley bans front-yard turf on houses. Since 2026, new commercial and HOA-common landscapes can’t use nonfunctional turf.

  2. Can my HOA stop me from installing artificial turf in Colorado?

Not in the backyard of a detached single-family home. Colorado law (C.R.S. 38-33.3-106.5) bars an HOA from prohibiting artificial turf there, though it can still apply design rules and review your plans. Front yards aren’t protected, and on an attached home such as a townhome the HOA may limit turf to rear yards. This is general information, not legal advice.

  3. Can I put artificial turf over my septic drain field or tank?

Around the tank it can work if every riser lid stays uncovered at the surface. Over the drain field, keep turf off: Larimer and Weld rules want at least 10 inches of soil that supports plants there, free of compaction, and a turf base digs out soil and compacts rock. Ask your county health department first.

    1. What do the septic rules say goes on top of a drain field?
    2. Why is the turf base, not the turf, the real conflict?

    5. What happens when I sell, or when the system needs work?

  4. Is artificial turf considered xeriscape under Northern Colorado codes and HOA rules?

Usually not. Fort Collins' code defines xeriscape so that it excludes artificial turf, Windsor’s code says artificial turf isn’t "landscape," and Greeley’s defines xeriscape as low-water plants. Colorado law protects xeriscape and backyard turf as separate things. An HOA can define the word its own way, so read its documents first. General information, not legal advice.

    5. Why don’t these definitions count turf when it saves water?
